NetResourcer AWR Module

The Agency Workers Regulations (AWR) came into force on the 1st October 2011, the regulations  were designed to provide temporary agency workers with the same basic working and employment conditions of a comparable permanent employee after a qualifying period.

To comply with AWR, HotLizard implemented an AWR Module into their current NetResourcer recruitment software.  The module comprises two main components - the ‘Candidate Qualifying AWR Warning Report’ and the 'AWR Dashboard'.

Candidate Qualifying AWR Warning Report

The 'Candidate Qualifying AWR Warning Report’ is a csv report that outputs details of workers who have have been on assignment in the same job function with the same company for 10 consecutive weeks will be displayed. 

The report is based on the following rules:

  • Week 1 is based on the first day of a candidates assignment, regardless of which day of the week they start.

  • If a candidate takes a break from the same job function with the same company for 6 weeks or more and this candidates then starts another assignment with the same job function and the same company, the 10 week cycle will start again, i.e. it will be classed as week 1
  • A calendar week will comprise any period of seven days starting with the first day of an assignment

  • The report will be based on calendar weeks rather than timesheets, weeks will be accrued regardless of how many hours the candidate works on a weekly basis. Therefore, even if the candidate is on an assignment for only a couple of hours a week, it will still count as a week

  • Workers can qualify for AWR multiple times and against multiple companies and job functions.

The 'Candidate Qualifying AWR Warning Report’ will output the following worker information: 

[candidate name] [candidate ref] [company] [job title] [discipline] [job function] [week number]

AWR Dashboard

The AWR data will be displayed on a dashboard view, the dasboard will show any worker whose on assignment.

An ‘AWR Confirmed’ tick box option will be displayed against each candidate record on a per job function per company basis. When selected the appropriate candidate will then not appear on the ‘Candidate Qualifying AWR Report’. There will also be a date field against this as well as links to the AWR pay rates.

  • An option to ‘Pause AWR‘ will exist against each candidate on a per job function / per company basis. This is due to items such as jury service, sickness, industrial actions etc…

  • The system will allow a consultant to add pre and post AWR rates, when the ‘AWR Confirmed’ date has been entered and passed, the rate is pulled from the ‘post AWR’ rate against the appropriate rate type.

  • Post AWR Pay Rate and Post AWR Charge Rate can be pulled in via the timesheets and bookings from the date specified. When raising the booking, these rates are displayed alongside the normal rates. If the AWR date is entered after the date has passed, then only timesheets that have not been exported (and timesheet generated going forwards) will be updated.

  • Against each Candidate / Job Function / Company row within the AWR dashboard, there will be the ability to remove the candidate. This will remove the row and reset the timeframe calculation for that Candidate / Job Function / Company combination to 0 and only start counting them again should they be placed in a new assignment or if they are in an assignment that is still progressing.

  • To cater for Swedish Derogation (where AWR rights to equal pay of an agency worker no longer exist when agency workers are employed on a permanent basis by their umbrella company or temporary work agency and receive pay in-between assignments) a flag will be displayed against the candidate record to enable consultants to ‘flag’ certain candidates, the names of these candidates will be highlighted in red on the candidate record, booking browser, availability browser, shortlist, candidate results and AWR dashboard.
